These Website Terms of Use (“Terms”) govern access to and use of websites operated by Fibernet Corp. (“FIBERNET,” “we,” “us,” or “our”), including fiber.net and webpages, forms, portals, and online content that link to these Terms (collectively, the “Website”).
These Terms apply to use of the Website. They do not replace or modify any Master Service Agreement, Service Order, service-specific terms, Service Level Agreement, Acceptable Use Policy, or other written agreement governing Services purchased from FIBERNET.
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. FIBERNET SERVICES
FIBERNET provides technology and communications services that may include Internet and network connectivity, data center and colocation, hosting and cloud services, managed IT, cybersecurity, backup and disaster recovery, and related services.
Information presented on the Website regarding products, services, pricing, specifications, availability, facilities, capabilities, or features is provided for general informational purposes and does not create a contractual commitment unless expressly incorporated into a written agreement between FIBERNET and the applicable customer.
2. CUSTOMER AGREEMENTS CONTROL
Customers purchasing Services from FIBERNET may be subject to a separate Master Service Agreement, Service Order, service-specific terms and conditions, Service Level Agreement, Acceptable Use Policy, or other written agreement (collectively, a “Customer Agreement”).
The applicable Customer Agreement governs purchased Services. If these Terms conflict with a Customer Agreement regarding purchased Services, the Customer Agreement controls.
Nothing stated on the Website modifies a Customer Agreement unless the modification is expressly agreed to in writing as provided by that Customer Agreement.
3. ACCEPTABLE USE OF THE WEBSITE
You may use the Website only for lawful purposes and in accordance with these Terms.
You may not use the Website to: (a) violate applicable law or the rights of another person; (b) attempt to gain unauthorized access to the Website, accounts, systems, networks, servers, or data; (c) interfere with or disrupt the operation, availability, security, or integrity of the Website; (d) introduce malware, malicious code, viruses, automated attacks, or other harmful technology; (e) impersonate another person or organization or misrepresent your affiliation; (f) use automated tools, scraping technologies, crawlers, or similar methods in a manner that materially burdens the Website or circumvents reasonable technical restrictions; (g) probe, scan, test, bypass, defeat, or circumvent Website security controls without authorization; or (h) use Website forms or communications tools to transmit spam, fraudulent communications, abusive material, or unlawful content.
Acceptable use of FIBERNET Internet, network, hosting, cloud, and other customer Services is governed separately by FIBERNET’s Acceptable Use Policy and applicable Customer Agreement.
4. ACCOUNTS AND CUSTOMER PORTALS
Certain portions of the Website may require an account, login credentials, or other authentication. You are responsible for maintaining the confidentiality and security of credentials issued to you and for activity occurring through your account, except to the extent caused by FIBERNET.
You must promptly notify FIBERNET if you reasonably believe your account or credentials have been compromised or used without authorization.
FIBERNET may restrict or suspend access to an online account or portal when reasonably necessary to protect security, investigate suspected unauthorized activity, comply with law, or protect FIBERNET, its customers, systems, or networks. Suspension or termination of purchased Services is governed by the applicable Customer Agreement.
5. INTELLECTUAL PROPERTY
The Website and its content, including text, graphics, logos, photographs, videos, designs, software, documentation, trademarks, service marks, and other materials, are owned by or licensed to FIBERNET and are protected by applicable intellectual-property laws.
Subject to these Terms, FIBERNET grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Website for legitimate personal or business purposes.
Except as permitted by law or expressly authorized by FIBERNET, you may not reproduce, distribute, modify, sell, license, publish, create derivative works from, or commercially exploit Website content. Nothing in these Terms transfers ownership of FIBERNET intellectual property.
6. INFORMATION YOU SUBMIT
You represent that information you provide through the Website is accurate to the best of your knowledge and that you have the right to provide it.
Information submitted through sales forms, support requests, applications, account portals, or other Website functionality may be used by FIBERNET to respond to your request, administer customer relationships, provide or support Services, maintain security, and otherwise operate its business. FIBERNET’s handling of personal information is described in its Privacy Policy.
Submitting an inquiry, quote request, contact form, or similar communication does not obligate either you or FIBERNET to enter into a business relationship.
7. PRIVACY
Use of the Website is subject to FIBERNET’s Privacy Policy. Customer-specific confidentiality, security, and data-processing obligations are governed by the applicable Customer Agreement.
8. THIRD-PARTY WEBSITES AND SERVICES
The Website may contain links to or integrations with third-party websites, applications, platforms, carriers, payment processors, software providers, or other services. FIBERNET does not control unaffiliated third parties and is not responsible for their content, availability, security, privacy practices, or terms. Links are provided for convenience and do not necessarily constitute endorsement.
9. WEBSITE AVAILABILITY AND CHANGES
FIBERNET may modify, update, suspend, restrict, or discontinue any portion of the Website at any time. FIBERNET does not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
Any uptime, availability, performance, response-time, or other service-level commitment applicable to purchased FIBERNET Services is governed exclusively by the applicable Customer Agreement or Service Level Agreement and is not created by these Terms.
10. WEBSITE DISCLAIMER
THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIBERNET DISCLAIMS WARRANTIES REGARDING THE WEBSITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
FIBERNET DOES NOT WARRANT THAT WEBSITE CONTENT WILL ALWAYS BE COMPLETE, CURRENT, ACCURATE, OR ERROR-FREE. Nothing in this Section modifies an express warranty or service commitment contained in an applicable Customer Agreement.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIBERNET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE WEBSITE.
This Section applies to the Website and does not replace or modify any limitation of liability contained in an applicable Customer Agreement.
12. ELECTRONIC COMMUNICATIONS
When you communicate with FIBERNET electronically, you consent to receiving responsive communications electronically where permitted by law.
Marketing communications may be subject to separate consent, opt-out, or other requirements under applicable law. Transactional, security, billing, support, maintenance, and service-related communications may continue where reasonably necessary to administer a customer relationship or purchased Service.
13. CHANGES TO THESE TERMS
FIBERNET may update these Terms from time to time to reflect changes to the Website, business practices, technology, security requirements, or applicable law. The current version will be posted on the Website with an updated “Last Updated” date.
Changes to these Terms do not amend an existing Customer Agreement except as expressly permitted by that Customer Agreement.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Any dispute arising solely from use of the Website and not governed by a Customer Agreement will be subject to the state or federal courts having jurisdiction in Utah County, Utah. If a Customer Agreement applies to the dispute, its dispute-resolution and governing-law provisions control.
15. GENERAL
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect. FIBERNET’s failure to enforce a provision does not waive its right to enforce that provision later.
These Terms constitute the agreement between you and FIBERNET regarding use of the Website only. They do not constitute the entire agreement between FIBERNET and a customer regarding purchased Services.
